Name registration – You have to process a name first for the initiation of your business. The name has to be unique and should not exist in any form with any other service provider. You can go for a company registry search. Search for the name in the Hong Kong company registry and see if it matches with any existing one. The register has the names of all the small and large companies operating in the region. If you find that the proposed name already exists, come up with a fresh one. Once you have found a name that hasn’t been used, apply for its registration.
Application of incorporation – In order to incorporate the local limited company, an application needs to be submitted to the Hong Kong center of business incorporation. The application that must have met all the necessary requirements will be deemed as a simultaneous request for business registration under the company ordinance. Once approved, the Hong Kong company registry will issue the certification. The form can be downloaded from the Company’s Registry website or you can also Registry Search Online. In case of online registration, certificate will be issued within an hour provided all the specifications are precisely met. Any other process will require a minimum of 4 working days for the issue of certification.
For companies incorporated outside – Those companies that are incorporated outside the border of the country, but still have an established place should submit all the documents to the Registrar of Companies within one month of the establishment. In this case, the Hong Kong company registry will release a business registration certificate for Non-Hong Kong Company. It takes normally a period of 14 days from the issue of certification provided all the conditions are met perfectly.
Once you have received all the registration certificates and legal documents, you can commence with your business operations full throttle. Make sure that if you want a trademark for your business, you need to apply for it within six months of the incorporation of the business.
